Utah Pre-Litigation Medical Malpractice Panel Request

File the request with the Utah Division of Professional Licensing under Utah Code § 78B-3-416. The request must include the names of all health care providers against whom the claim is asserted, a description of the alleged act or omission, the alleged injury, and supporting medical records. The panel must convene within 180 days of the request unless extended by stipulation. Statute of limitations is tolled during the pendency of the panel proceeding under Utah Code § 78B-3-416(2)(c). The panel's findings are not admissible at trial under § 78B-3-417, but its certificate of compliance is required before filing suit. From a defense perspective, the panel proceeding is a valuable early window for case evaluation, document review, and identifying liens and treating provider testimony.
