Putting the Survey to Use

This survey compares pre-suit notice requirements across the four Mountain West jurisdictions for three claim categories. For governmental tort claims, the survey covers the Colorado Governmental Immunity Act (CRS § 24-10-109), the New Mexico Tort Claims Act notice provisions (NMSA § 41-4-16), the Utah Governmental Immunity Act (Utah Code § 63G-7-401), and the Wyoming Governmental Claims Act (Wyo. Stat. § 1-39-113). For construction defect, it covers Colorado's CDARA notice and Utah's Construction Defect Action Procedure Act analog. For medical malpractice, it covers Utah's mandatory pre-litigation panel (Utah Code § 78B-3-416) and Wyoming's Medical Review Panel (Wyo. Stat. § 9-2-1518). Use the survey to triage incoming matters and identify procedural defenses early.
